We are delighted to announce that the Nepal International ADR Center (NIAC), is organizing ADR week in collaboration with Asia Pacific Center for Arbitration and Mediation (APCAM), in Kathmandu. The event will focus on the theme:
“Modernizing Dispute Resolution: The Role of ADR in Enhancing Access to Justice”
This event promises an unprecedented opportunity and scope for legal professionals, judges, arbitrators, mediators, engineers, management experts, business leaders, and scholars interested in arbitration and mediation from different parts of the world to enhance their knowledge and experience, amidst the enchanting backdrop of Nepal’s rich culture and natural beauty.
NIAC incorprorated as a non-profit entity provides both domestic and international commercial dispute resolution services. It comprises a diverse group of experts, including jurists, lawyers, management professionals, engineers, chartered accountants, arbitrators, mediators, and academicians. Beyond dispute resolution, NIAC strives to fostering knowledge and skill development in ADR contributing to the advancement of the field.
NIAC, as a founding member collaborates with the Asia Pacific Centre for Arbitration and Mediation (APCAM) to enhance the quality and scope of arbitration and mediation service across the jurisdiction.
The legal framework for arbitration and mediation in Nepal provides a basic foundation, outlining clear procedures and standards for ADR neutrals, ensuring that the processes are fairly structured. However, there remains a lack of widespread awareness and acceptance of ADR as viable options in lieu of litigation.
Ensuring consistent and quality training for arbitrators and mediators remains an ongoing challenge. Continuous professional development and the establishment of standard practices are crucial to maintain ADR credibility and effectiveness consistent and well thought out. Judicial interpretation and application of related laws need to promote these practices. As a party to the New York Convention 1958, we await an ADR-friendly judiciary, fair “Public Policy” interpretation, and well-informed corporate community for gain-gain mutual dispute resolution and effective arbitral award enforcement set-up.
Abundant avenues for FDI are available in hydropower,tourism,transportation, communication, agro- farming and many other domains in Nepal. There is a pressing need for more trained and experienced ADR neutrals who can lend credence to ADR thoughts from outside the country.
With this backdrop, the ADR week will feature expert insights from leading practitioners in arbitration and mediation from different part of the world. Alongside the presentations and sharings from highly distinguished experts, the event will offer valuable networking opportunities allowing participants to connect with professionals from a myriad of sectors including law, business, academia, and so on. Building these relationships can foster future collaborations and create career opportunities for all of us.
